NSW: Showground ride operator fined over workplace death
SYDNEY, April 30 AAP - A showground ride operator has been fined $29,000 and orderedto pay a double insurance premium after a worker died cleaning a ride at Sydney's RoyalEaster Show.
WorkCover NSW took the case to the NSW Chief Industrial Magistrates Court, claimingthat Brooks Crown Amusements breached health and safety codes, and failed to have insurance.
The case involved an accident at the Royal Easter Show at Homebush on March 24, 1999.
The court was told the cleaner was working on the Turbo Ride when it started carryinghim 10 metres into the air.
He fell, suffering fatal injuries, when the emergency stop button was pressed.
Amusement ride operator Kevin Cyril Brooks, who did not appear in court, pleaded guiltyto the breaches.
He was fined $12,500 for the two safety breaches and $4,000 for failing to obtain workers'compensation insurance.
The court also ordered that he pay double the avoided insurance premium of $998 andWorkCover costs of $10,000.
WorkCover NSW general manager Kate McKenzie said the case highlighted the need fora safe workplace.
"This tragic case emphasises the need for employers to provide and maintain safe systemsof work and to ensure that plant is kept in safe working condition," she said.
