NSW: Casino watchdog loses bid not to be sued over death

The NSW casino watchdog has lost a bid to be removed from legal action over the death
of a man after he was restrained by bouncers at Sydney's Star City Casino.

Twenty-three-year-old PANGIOTIS DALAMANGAS died in January 1998 following an incident
with bouncers at the casino.

Mr DALAMANGAS' parents VASILIOS and CHRYSO DALAMANGAS and his defacto wife JOANNE FEREKOS
are suing the NSW Casino Control Authority and Star City for negligence over the death.

The casino authority has argued that it did not owe a duty of care to Mr DALAMANGAS
under its legal powers and functions.

But in the NSW Supreme Court,m Justice PATRICIA BERGIN has found the security activities
of the casino do fall under the authority's control and she's dismissed the application
to be removed as a defendant.
